General Sales Conditions

These general sales conditions apply exclusively to the commercial relationships existing between ELIART, SAS registered at Paris RCS with number 531 686 145, situated at 9, cité Popincourt, 75011 Paris, France, and any physical person or legal entity that has ordered through this site, www.eliart-editions.com, one or any of the books presented herein. The mere fact of placing an order implies automatic acceptance, full and unreserved, of these terms.

Article 1. Availability
Eliart publishing house offer their catalog on this site. The books are available for sale at the time of the order within the limits of our stock.

Article 2. Price
Prices are in € (euros) and all taxes included apart from shipping costs. They take into account the French VAT and comply with the Lang law of August 10, 1981. The publisher may modify them at any time without prior notification. However, invoices will be established on the basis of the applicable tariffs at the time of the order. Duties or other taxes may be required. They will be passed on to the customer and remain under his sole responsibility.

Article 3. How to place an order
To order click on the ‘Buy’ icon. A window called ‘your basket’ will open. You may either continue purchasing or pay immediately. The click marking acceptance of the order declares that the client accepts the offer and its conditions. Our publications may be purchased from your local bookshop. Please consult the listing of bookshops offering our books (section ‘Sales outlets’).

Article 4. Means of payment
It is possible to pay directly at this site with your bank card. The client will be redirected to the online PayPal site, which provides safe, transparent transactions. No banking data will be stored on this site. Warning : your order is final only when payment has been received and the order verified.

Article 5. Ownership and Risk Transfer
Ownership transfer to the client occurs only when the payment is complete, whatever the delivery date. Loss and deterioration risk transfer, however, is performed when the books are received by the client.

Article 6. Geographical Area
The Online sale of products and services at this site is limited to buyers in Metropolitan France.

Article 7. Delivery, delays and delivery cost
The books will be delivered in France at the address provided during the ordering process. Shipping costs are shown in your cart. Delays may vary according to the shipping areas. But the publisher undertakes to send the orders in the shortest possible time.

Article 8. Guarantees
The customer has a withdrawal period of 7 days from the receipt of the order. Sealed, it must be returned within that time in perfect condition - the cost of return borne by the customer - except in case of error on our part. Any claim or dispute must be made under penalty of forfeiture, by registered mail, with a copy of the invoice and the reason for return, within 7 days of delivery. After this period, the order will be definitively confirmed. Returns are to be made to the address indicated above.

Article 9. Responsibility
All photographic reproduction with such works is not within the scope of the contract. If errors are introduced, in no event shall Editions Eliart be liable. In case the product is unavailabe or out of stock, force majeure, disruption or total or partial strike, including postal services and transport, flood, fire, the publisher can not be held liable for breach of contract.

Article 10. Confidentiality of Personal Data
The editor handles all customer information with the utmost confidentiality, and no bank data is stored on this site. Accordance to Article 40 of the Data Protection Act as amended, the customer has a right of access, modification, rectification and deletion of data. To do this, simply send us the request online or by mail.

Article 11. Applicable Law
This contract is subject to French law. In case of dispute, jurisdiction is conferred to the competent courts of Paris, notwithstanding plurality of defendants or warranty.
